POSITION DESCRIPTION – DIRECTOR OF COMPLIANCE

The Director of Compliance is a full-time, Shakman Non-Exempt position and the conditions of employment will not be subject to Political Reasons or Factors. The Director of Compliance’s primary goal is to facilitate the Office of the Clerk of the Circuit Court of Cook County’s (“Clerk’s Office”) compliance with the Supplemental Relief Order (“SRO”) in Shakman, et al. v. Clerk of the Circuit Court of Cook County, et al., 69 C 2145, dated August 10, 2018. Once the Employment Plan for the Clerk’s Office is finalized, the Director of Compliance will be responsible for performing those tasks assigned under the Employment Plan and for coordinating and monitoring the implementation of the Employment Plan consistent with the prohibition of Unlawful Political Discrimination in employment decisions. The Director of Compliance also provides meaningful input into the development, revision, and implementation of the employment policies of the Clerk’s Office as they relate to the Employment Plan, as well as all other relevant policies. These responsibilities extend during and after judicial oversight under the SRO.
The Director of Compliance monitors activities pertaining to the employment of Shakman Non-Exempt personnel in the Clerk’s Office including, but not limited to, the hiring process, overtime, transfers, discipline, time and attendance violations, layoff and recall, annual evaluations, performance improvement plans, interim assignments, reclassifications, and training. The Director of Compliance reviews employment documents relating to Shakman Non-Exempt employment actions and recommends revisions. The Director of Compliance monitors the Shakman Exempt position hiring process in accordance with the Employment Plan. The Director of Compliance prepares reports for the Clerk of the Circuit Court of Cook County (“Clerk”), the Clerk Compliance Administrator (“CCCA”), and the Court concerning the Employment Plan and other relevant policy issues.
Essential Job Duties
Key responsibilities and duties include, but are not limited to, facilitating compliance with the terms of the Employment Plan and other relevant policies, and taking appropriate action to report instances of Unlawful Political Contacts and Unlawful Political Discrimination including, but not limited to:
· Monitoring and auditing compliance with the Employment Plan and other relevant policies to identify and assess potential and existing problems, discrepancies and/or violations, and reporting any potential and existing violations to the Clerk and the Clerk’s Chief of Staff (“Chief of Staff”);
· Reviewing documents relating to Shakman Non-Exempt employment actions and recommending revisions;
· Serving as the liaison between the Clerk’s Office and the CCCA;
· Accepting, investigating, and reporting on complaints of alleged violations of the Employment Plan, other relevant policies, and Unlawful Political Discrimination in the employment actions of the Clerk’s Office;
· Preparing and forwarding final reports on investigations of complaints of alleged violations of the Employment Plan and other relevant policies to the Clerk, Chief of Staff, CCCA and Plaintiff’s Counsel;
· Conducting, supervising and monitoring the training of supervisors, managers and directors within the Clerk’s Office on compliance with the Employment Plan and other relevant policies, and appropriate methods for preventing and reporting Unlawful Political Contacts and Unlawful Political Discrimination;
· Monitoring all facets of the Shakman Non-Exempt hiring process to identify and assess potential and existing problems, discrepancies and/or violations and reporting the results of such monitoring to the Clerk, Chief of Staff, and CCCA;
· Monitoring of the Shakman Exempt hiring process as provided in the Employment Plan including, but not limited to, position description evaluation and minimum qualification review;
· Receiving and maintaining reports and logs of Political Contacts on employment matters from employees, and periodically distributing summaries of the logs to the Chief of Staff and the CCCA;
· Monitoring all facets of employment actions including, but not limited to, overtime, transfers, discipline, time and attendance violations, layoff and recall, annual evaluations, performance improvement plans, interim assignments, reclassifications, and training, in order to identify and assess potential and existing problems, discrepancies and/or violations, and report the results of such monitoring to the Chief of Staff;
· Providing first-hand information, observations, assessments, and recommendations on the development, revisions and implementation of the employment policies and practices of the Clerk’s Office, noting any irregularities which may compromise compliance with the Employment Plan, other relevant policies, Shakman Decree, while in effect, SRO, and other court-ordered directives;
· Preparing reports of complaints received and investigated to the Clerk and the CCCA;
· Monitoring the maintenance and posting the Shakman Exempt List;
· Consulting with, advising and informing managers and employees involved in employment actions regarding the requirements of Shakman compliance, the Employment Plan and other relevant policies;
· Other related duties consistent with the Employment Plan, relevant sections in the policies of the Clerk’s Office, and the prohibition of Unlawful Political Factors in the employment actions of the Clerk’s Office.

The Director of Compliance will exercise broad discretion and latitude in performing the duties when providing the Clerk and Chief of Staff with information and suggestions aimed at preventing potential problems in the hiring, promotion, transferring and selection process. The Director of Compliance must use sound, professional judgment in the handling of highly confidential matters.
· Graduation from an accredited college or university with a Bachelor’s degree.
· Seven (7) years of full-time paid work experience in human resources, compliance, or employment law in the public or private sector.
· Two (2) years of investigative experience, which may include investigating allegations of sexual harassment, employment discrimination, or other misconduct in the workplace.
· Graduation from an accredited college or university with a Master’s degree or higher in Human Resources, Business, Public Administration, Labor Relations or related field, or a J.D. degree from an accredited law school and license to practice law in Illinois.
· Ten (10) years of full-time paid work experience in human resources, compliance or employment law.
· At least two (2) years full-time paid work experience within the public sector.
Knowledge, Skills and Abilities
· Must be computer literate, with skill and efficiency in preparing informative reports.
· Ability to communicate effectively both orally and in writing.
· Ability to work with others; excellent interpersonal skills in dealing with the public and co-workers.
· Knowledge of the Clerk’s Office’s procedures, polices, practices and guidelines.
· Knowledge of the procedures related to Clerk’s Office’s operations, function, activities and the court system at-large.
· Working knowledge of the Employment Plan, other relevant policies, and any applicable collective bargaining agreement(s).
· Experience with job classification, position descriptions, labor grievances and collective bargaining.
· Excellent organizational skills, the ability to prioritize tasks, and skills to develop and meet timetables.
· Ability to effectively utilize time with limited oversight.
· Ability to identify potential or existing irregularities and discrepancies in the selection, hiring, transfer, promotion or other employment actions and to demonstrate where the processes are working most effectively.
· Ability to analyze data and other reports and/or allegations of impropriety, thereby diagnosing problems and preparing possible solutions and action plans in a concise and accurate manner.
· Knowledge of all aspects of human resources administration and personnel management, particularly within the context of a municipal government setting.
· Excellent listening skills, coupled with the ability to conduct interviews and interact effectively with employees at all levels, including managers and those just entering the work force.
